In July 2001 Ray Dunn suffered a career ending injury as a result of a few pieces of track falling out of a scissor-lift. A safety expert demonstrated that this scissor-lift was improperly operated and loaded by under-trained Finishers employees. These pieces of track struck him in the back of the head smashing his fiberglass hardhat. A safety expert and Chris Troxel's own employees testified under oath describing numerous unsafe work practices. An occupational rehabilitation expert described future earnings, after years of retraining, that were a fraction of Ray's previous earning power. This accident caused severe pain, depression and lost strength. In 2002 Finishers Corporation was sued as a result of this accident. The jury decision found Finishers Corporation 92% liable and the general contractor 8% liable. In 2004, after an appeal was denied, Finishers Corporation paid to satisfy a judgment of over four million dollars including Ray Dunn's legal costs.
This accident tragically changed Ray Dunn's life and ended the promising career he had prior. As a construction user this kind of heartbreaking legal dispute is the last thing you want on your project.
