In 2005 the Circuit Court for the County of Multnomah, Oregon, rendered judgment of almost $100,000 against Finishers Corporation for "fraud". The Court found that Finishers defrauded BR&R Insurance.
The scheme involved writing checks to secure insurance to obtain payments from constructions companies and then canceling the checks to make payroll. Finishers wrote the checks with no intention of paying them. Finishers tried to defend its blatant unlawful conduct by claiming that if it did not defraud the insurance company it would have gone out of business. Specifically, Finishers claimed that "If [it] did not sign the checks, it was without insurance and would have to go out of business." Such a defense is ridiculous. No one has the right to commit fraud in order to stay in business.
However, in typical Troxel-company fashion, Finishers filed bankruptcy before paying its debt. The debt was discharged as indicated in the Bankruptcy page .
